On 20 September 2021 the Official Journal of the EU published Commission Regulation (EU) 2021/1532 of 17 September 2021, which amends Annex I to Regulation (EC) No. 1334/2008 of the European Parliament and of the Council as Regards the Inclusion of 3-(1-((3,5-dimethylisoxazol-4-yl)methyl)-1H-pyrazol-4-yl)-1-(3-hydroxybenzyl)imidazolidine-2,4-dione in the Union List of Flavoring Substances. The act entered into force on 10 October 2021.

Verisk 3E Review

The new regulation amends Annex I, Part A, Section 2, Table 1 to Regulation (EC) No. 1334/2008 by adding a new food flavoring—FL No. 16.127. The authorization of the new food flavoring is accompanied by various restrictions for the respective food categories that are specified in the amendment.

In its opinion of 21 June 2016, the European Food Safety Authority (EFSA) concluded that the use of the new FL No. 16.127 does not give rise to safety concerns when limited to levels up to those specified in the text, and it is not expected to mislead the consumer.

Verisk 3E Analysis

Food business operators are informed of the inclusion of the new flavoring in the Europea Union list of flavoring substances. They also are advised to refer to the newly published text in order to see the detailed list of foods in which FL No. 16.127 may be added, with the respective maximum levels.

In absence of a transitional period, the authorization took effect on 10 October 2021.
