The State of California requires retail sellers provide consumers clear and reasonable product exposure warnings if the products purchased expose someone in California to listed substances that cause cancer or reproductive harm. The regulation is commonly known as Proposition 65 or simply Prop 65. ABC Supply is requesting suppliers provide information on whether their products require a Proposition 65 warning so they can be sold to consumers in the State of California and to mitigate risk.

Q: I received an email asking for information. Why is 3E™ contacting me?

A: As a supplier to ABC Supply you are being asked to complete compliance surveys. The above data collection form is required in order to sell product through ABC Supply. ABC Supply is striving to comply with e-commerce and product labeling laws with Prop 65 with all the products that you supply and they sell.

Q: Why does ABC Supply need this?

A: It is the law for products making it to CA or already in CA. Fines for non-conformance can be sited to the entire supply chain, no matter what state or country, by private attorneys or an Attorney General in CA at $2,500 per day per incident. The average settlement in 2017 was $37,453. 

Q: I have a company statement/policy covering Prop 65 compliance.  Can I provide that instead?

A: You can provide that in addition, with your emailed Declaration Template, but not instead.  ABC Supply needs all suppliers to have the agreed upon Declaration Template completed. As the regulation changes the Template may also change from year to year.  The link is kept accurate with the current required ABC Supply Declaration Template.

Q: I submitted this to ABC Supply before August of 2019 can I just send that or an old response again? If not, why?

A: No you cannot resend old responses. ABC Supply will not allow for a previous response and apologizes for any inconvenience.  The manner and detail of which previous campaigns for Prop 65 were conducted will not lead to full compliance with the current law.  ABC Supply has contracted with 3E to modify the request so that it is compliant with current law at the time of the request.  Future requests may change if the law changes again.  Furthermore the Prop 65 list can change at any time which can change your response.

Q: I do not recognize ABC Supply as a customer. What should I do?

A: This campaign is not just for ABC Supply but also for many companies that make up ABC Supply Holding Corp..You might instead recognize the name American Builders & Contractors Supply Co., Inc., L&W Supply Corporation, Town & Country Industries, Eastside Wholesale Supply Co. or Mule-Hide Manufacturing Co., Inc. One of these ABC Supply companies indicated they purchase from you. Please provide a response for any product sold in the last two years at a minimum.  Please let 3E know at ABCSupply@3eco.com if a product listed has not been sold by your company, parent company or sister company to one of these companies above longer than two years. Product remaining in inventory in the supply chain is subject to the law and subsequent fines up the supply chain including your company.

Q: I don’t sell in California. Do I still need to complete the declaration?

A: Yes. Your product only needs to make it to CA to include you in required compliance and potential 60 day notice. ABC Supply also requires the declaration. It is not possible to simply state that your product should not be sold in CA.  There is no way to control a product being transferred by a ABC Supply customer from one state into CA. The risk is too great given the law and the 60 day notices possible.

Q: What is a 60-day notice?

A: Please see the above resource page. The entire supply chain and the Attorney General will have only 60 day to prepare your case if a private attorney were to allege your Prop 65 warning is non-compliant. An Attorney General has 60 days to determine if they will pick up the case or allow the private attorney to have a suit on behalf any citizen of CA.

Q: None of our products require Proposition 65 warnings. Does ABC need a listing of all products even those that do not Proposition 65 warning?

A: Yes. Since the list of Prop 65 chemicals changes it is important to know on what date your company reviewed your current reasonable warning requirement against the current list of Prop 65 chemical. When a new chemical is listed the entire supply chain has one year to list any exposure to the newly listed chemical.

Q: Proposition 65 information for all of our products can be found on our website. Do I still need to complete the declaration?

A:  Yes. ABC Supply needs the Declaration Template. See answers above as to why. You should consider all products sold within the last two years or are reasonably expected to still have not met their final customer. The warning is required at the time of the sale in CA.

Q: I have recently submitted California Proposition 65 information directly to ABC Supply, do I need to do it again?

A: Yes. ABC Supply needs the Declaration Template. Please forward any correspondence with ABC Supply along with the Declaration Template.

Q: Where can I find the list of chemicals covered by Proposition 65?

A: See the above resource page for information on Prop 65 and the current list of chemicals.

Q: How do I know if my products need a Proposition 65 warning?

A: Presence is not necessarily exposure, however, if you do not have defendable proof of no exposure when you have presence it is suggested you warn and work to then remove the warning if you can prove no exposure. 3E has free ABC Supply support and if necessary has consulting services that can help you make this determination. First see the above resource page for information on Prop 65 and the current list of chemicals.  Not all chemicals have exposure levels. It may be required not only that you determine presence but also the safe harbor level if OEHHA has not already determined that level.  Only then can you determine exposure or potential exposure.
