Were there recent changes made to the TSCA Export Notification Requirements?
On November 14, 2006, EPA promulgated a final rule amending the Toxic Substances Control Act (TSCA) Section 12(b) export notification regulations. Perhaps the biggest change comes in the form of reduced reporting for exporters of certain chemical substances or mixtures. Specifically, chemical substances or mixtures subject to TSCA section 5(e) consent orders or section 5(a)(2) proposed or final significant new use rules (SNUR) will only require one-time notification, rather than annual notification.
Another substantial change to the export notification requirements is the adoption of de minimis concentration levels below which notification will not be required for the export of any TSCA 12(b) chemical.
Other amendments include an updated EPA address to which export notifications must be sent and the option that a single export notification may refer to more than one section of TSCA where the exported chemical is the subject of multiple TSCA actions.
The Federal Register notice may be found here. This rule becomes effective January 16, 2007.
